Last year we witnessed many changing trends in the policy structure of Department of Home Affairs. It was also witnessed that the subclass visa 457 was also abolished by the authorities and since then it has been replaced by Temporary Skills Shortage (TSS) visa 482.
Similar to the Sub-class 457, the Temporary Skills Shortage visa (TSS) enables business sponsors to nominate professionals who are living outside Australia for a period of maximum four years, which also depends on the occupational group that is being sponsored.
If the occupation is on the Medium and Long term Strategic Skills List (MLTSSL), the TSS visa can be granted for a period of up to four years. Also, if your application is in the MLTSSL, a permanent residency pathway can also be a viable option, provided if you have three years of employment in the said nominated occupation and that too with the same employer.
On the other hand, if the occupation is on the Short Term Skilled Occupation List (STSOL), the TSS visa can be granted for a period of up to two years along with possibility for a further visa renewal. The main purpose of the TSS visa is to assist the businesses that have acute shortage in the workforce and therefore have to find appropriate skilled labor.
Eligibility Requirements:
Business Sponsor:
It involves the process of Labor Market Testing in which the sponsoring employer will need to provide genuine evidence that they have made attempts to recruit for the nominated position from the local labor market. Although certain labor market testing restrictions do apply in this regard.
Minimum Market Salary:
Another criteria for TSS visa is that employers are required to meet the minimum market salary requirements. Employers are obliged to meet the current industry rates in Australia. This requirements is specifically known as the Australian Market Salary Rate (AMSR). In addition to this, the salary must also be above the Territory Skilled Migration Income Threshold (TSMIT).
Training Requirements:
In this requirement, employers who are nominating a worker for a TSS visa are required to pay a contribution to the Skilling Australian Fund that has been established by the Federal Government and Department of Home Affairs. At the current moment, the amount of contribution is $1200 per year or part year for businesses who have an annual turnover of less than $10 million and/or a contribution of $1,800 per year for any other business, the contribution is payable in full at the time of the nomination application.
Occupational Caveats:
Certain occupations have caveats associated with them, which means that if a business wishes to be nominated in a particular occupation that has a caveat, there are further requirements that have to be met.
